WHAT HAS YOUR CRIMINAL RECORD COST YOU? Have you been held back, passed over, and missed opportunities because of your criminal record? Employers, property managers, and schools frequently base critical decisions on criminal records. Legally, they may discriminate against people having either prior criminal charges or criminal convictions.

TYPES OF NORTH CAROLINA EXPUNGEMENTS. FLETCHER LEGAL files Expungement Petitions in every county across North Carolina. Before beginning the Expungement process, it’s important to realize that there are many different types of Expungements, including:

• Expunge a Dismissed Charge

• Expunge a Not Guilty Verdict

• Expunge a Misdemeanor Conviction

• Expunge a Juvenile record

• Expunge a Felony Conviction

• Expunge a Deferred Dismissal (§ 90-96)

• Expunge a Drug or Alcohol Record

WHAT IS EXPUNGEMENT? Expungement is the legal process where a person files a petition in court to have their criminal record, or portions of it, erased. Once a judge grants the petitioner’s expungement, they cannot be convicted of perjury for denying ever had the previous charge or conviction.

CRIMINAL CHARGES AND CONVICTIONS ARE PERMANENT. The general rule in North Carolina, is that neither criminal charges nor convictions may ever be removed from one’s criminal record unless the law specifically allows for removal (in other words, Expungement). North Carolina statutes must specifically allow this remedy, and petitioner must meet strict eligibility requirements.

ELIGIBILITY REQUIREMENTS. To qualify for Expungement in North Carolina, a petitioner must meet strict eligibility requirements. These requirements differ based on the precise statute under which relief is sought. Generally speaking, to qualify for Expungement, a person must have:

• No Criminal Record before the Charge or Conviction being Expunged.

• No Criminal Record after the Charge or Conviction being Expunged.

• A certain amount of time has passed since the case was resolved.

• Only certain offenses may be expunged; typically non-violent requirement. 

• The Petitioner was under a certain age at the time of the offense.

• The Petitioner has successfully completed every Court Order associated with the crime, including probation and payment of fines.

• Petitioner may have to pay a filing fee and / or obtain character letters.
